Sweet Vidalia Jingle Contest Rules:

Any contest participants less than 18 years old must have the written consent of their parent or legal guardian in order to participate in the contest. If the winner is less than 18 years old, an adult at least 21 years old must accompany the winner on the grand prize trip. Here is the

About the Contest

Vidalia farmers want to hear your creative jingle about their sweet onions! Prizes will be awarded for the video with the most artistic, creative talent and also the video with the most votes.

Here are some theme ideas for creating your jingle:

  • Sweet taste of Vidalia Onions
  • Vidalia Onions are only grown in Southeast Georgia
  • Your favorite memory or recipe with Vidalia onions
  • Vidalia Onions are only available during Spring and Summer
  • Vidalia Onions are the original sweet onions!

A panel of judges including a Universal Music representative will vote for the best artistic song which will be the Grand Prize winner.

Site visitors are encouraged to vote on their favorite jingle because it is their votes that will decide the first place winner.

By submitting an online entry, the Jingle Contest entrant understands that these Rules form a legally enforceable agreement with the Vidalia® Onion Committee and intends to be bound thereby. Please read the remainder of these Rules carefully, as they detail your rights and obligations under this agreement.

How to Enter:

Write a jingle about sweet Vidalia onions, create a video of your song and post your video onYouTube. To participate in the Sweet Vidalia Jingle Contest, visit the Submit Your Video section of this web site, submit the required information on the official entry form and upload your YouTube URL link on this form by 5:00 pm EDST on July 1, 2011.

Only one entry form is permitted per person. In order to participate and win you must fill out all of the required information. This jingle contest will begin on May 1, 2011 and will end July 1, 2011, at 4:59 p.m. EDST. All entries must be received no later than 4:59 p.m. EDST, July 1, 2011.

The Committee is not responsible for late, lost or misdirected entries, or for technical, hardware, software or telephone malfunctions of any kind, lost or unfavorable network connections, failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender or by any of the equipment or programming associated with or utilized in this contest which may limit the ability to participate or by any human error which may occur in the processing of the entries in this contest or otherwise.

Video Submission Guidelines:

  • Entrants are limited to one video submission per person.
  • All approved submissions will be uploaded to the site by the Vidalia® Onion Committee (“VOC” or the “Committee”).
    • The VOC may not approve a submission if the content is deemed inappropriate in VOC’s sole discretion.
  • Videos shall be a creative, musical jingle. Any video which appears on the contest site has been approved by the Vidalia Onion Committee and is eligible to win the contest.
  • The Vidalia Onion Committee will tabulate the number of votes for each video received. Votes will determine the outcome of the first and second place winners of the competition.
  • After submission on the VidaliaOnion.org/contest website, videos will be live on YouTube and may be embedded freely onto other sites including but not limited to Facebook®, MySpace®, blogs or any other social networking sites.
  • The Vidalia Onion Committee retains the rights and use of each video submitted indefinitely, and may use it in any manner it deems appropriate without compensation given to the subjects of the submission.
  • Entries may consist of groups with any amount of performers, but the prizes remain the same, no matter how many people are in the group.

Voting

Viewers may vote on a video or multiple videos as many times as they wish, but The Vidalia Onion Committee reserves the right to block any votes that are suspected of fraud and disqualify them from the tally. The number of votes will be tallied online at VidaliaOnion.org/contest. Visitors will be able to vote on their favorite video online starting May 1, 2011 through August 5, 2011. All votes will be received no later than 11:59 p.m. EDST on August 5, 2011.

Contest Prizes:

Grand Prize: Ultimate Nashville Getaway!

The grand prize will be awarded for the most artistic, creative song as determined by a panel of judges.

One grand prize winner will receive a trip including round-trip airfare for two, hotel accommodations for two nights and Nashville’s official VIP Backstage booklet that contains a number of savings offers on entertainment, dining and recreational activities in Nashville.

Approximate retail value of prize is three thousand United States dollars ($3,000 USD).

The Grand Prize package includes a 3-day/2-night trip to Nashville, Tennessee for up to two people (maximum of one hotel room), consisting of roundtrip coach airfare to Nashville, Tennessee from the international airport in the continental United States closest to the winner’s city of residence (the “Departure Airport”) (choice of Departure Airport will be determined by the Committee in its sole discretion), lodging in Nashville for two nights and a Nashville VIP Backstage Pass booklet that contains a number of different savings offers on entertainment, dining and recreational activities in Nashville.

(If, however, the winner lives in Nashville or within a reasonable driving distance of Nashville, TN, as determined by the Committee in its sole discretion, then airfare for winner and his or her travel companions will not be included in the prize package, and ground transportation will be substituted. The Committee shall have no other obligation to substitute the airfare portion of the prize.) Transfers to and from the Departure Airport are not included; transfers to and from the airport in Nashville are included. If an overnight stay in a connecting or stop-over city is necessary due to a connecting flight or a delayed/cancelled flight, hotel accommodations (based on one room occupancy) in connecting or stop-over city (to be arranged by the Sponsor) and ground transportation to and from the airport in the connecting/stop-over city are included. Method of ground transportation will be taxi. Applicable hotel taxes, airport and departure taxes and other flight-related fees and charges are included. However, the prize does not include meals, insurance (travel, health, accident and other), any personal items (e.g. phone calls, laundry, etc.), alcoholic or other beverages, gratuities, transportation to and from airports or between other points (except as expressly listed above), or other incidentals relating to the trip. The winner and his or her travel companions are responsible for arranging appropriate insurance (travel, health, accident, etc.) for themselves.

The prize is not transferable or convertible to cash (except at Committee’s sole discretion) and must be accepted as awarded.

First Prize: $1,000

The first place winner is determined by the video that has received the most votes. The votes will be tallied and showcased on the campaign micro web site Vidaliaonion.org/contest.

One first place winner will receive $1,000 in the form of a Visa gift card to be used as a cash reward.

All federal, state and local taxes are the sole responsibility of the winner, except as otherwise expressly provided in these rules.

Second Prize: 4 Country music CDs per winner

Two second place prizes will be awarded. This includes the video that ranks second in the most popular (or number of) votes and the second place winner of the artist song as determined by a panel of judges. The winner of each category will receive 4 country music CDs.

The prize is not transferable or convertible to cash (except at Committee’s sole discretion) and must be accepted as awarded.

All federal, state and local taxes are the sole responsibility of the winner, except as otherwise expressly provided in these rules.

Winner Selection:

All entries submitted will be screened by the Committee for compliance with these Rules. Those entries not meeting these Rules will be disqualified without further notice. All entrants will be considered for the prizes. Entrants are limited to one video submission per person. Once an entrant has won a prize, all remaining chances for that entrant become void. By entering, entrants agree that the decisions of the Committee with respect to the selection of the winners and in regard to all matters relating to this Jingle contest (including, without limitation, regarding eligibility) shall be final and binding on all entrants. In return, the Committee commits to exercise good faith in the analysis of eligibility to win prizes and to ensure equal treatment of entries.

Judging:

The judging panel for the Grand Prize and Second Place Winner is chosen by the Vidalia Onion Committee in their sole discretion. All entries submitted will be screened by the Committee for compliance with rules. Those entries not meeting the Contest rules will be disqualified without further notice. All remaining entries will be considered for the prizes.

By entering, Entrants agree that the decisions of the Committee with respect to the selection of the winner and in regard to all matters relating to this Contest (including, without limitation, regarding eligibility) shall be final and binding on all Entrants.

The judges will select the top winners. The decisions of the judges with respect to the selection of the winner and in regard to all matters relating to this contest shall be final. The winners will be notified by telephone or e-mail on or before September 30, 2011.

Winner Notification and Acceptance:

Winning entrants will be notified by telephone or e-mail by September 30, 2011. If a selected entrant cannot be reached within 10 days following September 30, 2011, he or she will forfeit any right to a prize and the prize will be awarded to another entrant.

The winner and his or her city and state of residence will also be posted on the Committee’s website at www.VidaliaOnion.org by October 15, 2011 and will remain so posted for a minimum of 30 days.

A winner may waive his or her right to receive a prize. Prizes are non-assignable and non-transferable. No substitutions will be allowed, except as stated herein. The Committee reserves the right to substitute all or part of a prize with one of equal or greater value. Except as expressly provided otherwise in these Rules, the winners are solely responsible for the reporting and payment of any taxes on prizes. As a condition of receiving a prize, each winner, or the parent or guardian thereof, will be required to complete an affidavit of eligibility, liability and publicity release and indemnity, in the form required by the Committee, which must be signed and returned prior to the winner claiming his/her prize. A winner’s signed affidavit of eligibility, liability and publicity release and indemnity must be received by the Vidalia Onion Committee within 14 days of the date on which it is delivered to the winner for signature. Failure to sign the foregoing (or to return them within the specified time period), or to comply with any term or condition of these Rules, may, at the sole discretion of the Committee, result in winner's disqualification and the forfeiture of his or her interest in the prize.

The Committee will arrange for delivery of prizes to winners. Shipping and handling expenses to deliver prizes to the winners will be paid by the Committee. The shipping method chosen is in the sole discretion of the Committee.

Participation:

Participation in the Jingle Contest constitutes an agreement by each entrant to comply with these Rules. The Committee reserves the right to cancel or modify the Jingle Contest (with or without awarding any of the prizes) if it determines, in its sole discretion, but in good faith, that fraud or technical failures or other difficulties or errors have destroyed the integrity of the Jingle Contest or rendered the contest incapable of being conducted as planned. Without limiting the generality of the foregoing, the Committee reserves the right in its sole discretion to cancel, terminate or suspend the online portion of the Jingle Contest should an unauthorized intervention or other cause beyond the control of the Committee affect the administration or proper conduct of the Jingle Contest.

Construction:

Subject to applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the entrant and the Committee in connection with the contest, shall be governed by, and construed in accordance with the laws of the State of Georgia and the laws of the United States applicable thereto, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Georgia, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Georgia, and entrants irrevocably submit to the exclusive jurisdiction of the courts of Georgia with respect to any matter arising hereunder or related hereto. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

General Release:

By entering the Jingle Contest, entrants release (i) the Vidalia Onion Committee and each of their respective affiliated entities (including all of their respective successors and assigns), and (ii) the directors, officers, employees, representatives and agents of those in (i) (collectively, the “Releasees”) from, and waive, any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind (including cost and expenses related thereto) arising out of or in connection with the Jingle Contest, the acceptance, possession, or use of any prize, and/or the Authorized Acts defined below (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, intellectual property, defamation, or portrayal in a false light).

Entrants agree that they will not make any claims against the Releasees or any claim against any third party which may result in a claim against any of the Releasees in respect of any matter in any way relating to this Contest or the prizes or the Authorized Acts (as herein defined).
